    Department Of Labor: LinkedIn To Pay $6 Million In Unpaid Overtime, Damages

    The United States Department of Labor announced that LinkedIn has agreed to pay $3,346,195 in overtime back wages and $2,509,646 in liquidated damages to 359 former and current employees. The money will go to people from the company’s California, Illinois, Nebraska and New York branches.

    The DoL’s Wage and Hour Division investigated the company, finding that it violated the overtime and record-keeping provisions of the Fair Labor Standards Act. The company agreed to pay all overtime back wages and due, when notified about the violations. The company has apparently also taken steps to prevent violations from occurring in the future.

    “LinkedIn failed to record, account and pay for all hours worked in a workweek, investigators found,” said the department. “In addition to paying back wages and liquidated damages, LinkedIn entered into an enhanced compliance agreement with the department that includes agreeing to: provide compliance training and distribute its policy prohibiting off-the-clock work to all nonexempt employees and their managers; meet with managers of current affected employees to remind them that overtime work must be recorded and paid for; and remind employees of LinkedIn’s policy prohibiting retaliation against any employee who raises concerns about workplace issues.”

    “Off the clock’ hours are all too common for the American worker. This practice harms workers, denies them the wages they have rightfully earned and takes away time with families,” said Susana Blanco, district director for the division in San Francisco. “We urge all employers, large and small, to review their pay practices to ensure employees know their basic workplace rights and that the commitment to compliance works through all levels of the organization. The department is committed to protecting the rights of workers and leveling the playing field for all law-abiding employers.”

    You would think the “professional” social network would know better. I guess it does now.

    McDonald’s Employees Sue, Claim Wage Theft

    According to the Chicago Tribune, there have been seven class-action lawsuits filed by McDonald’s restaurant employees recently. The suits charge McDonald’s with systematically stealing wages from employees in a variety of ways.

    Some of the plaintiffs said that the burger chain did not pay overtime as they were required to do. Others said they were forced to do work “off the clock”, pay for their own uniforms, and were not given timely breaks at work.

    A spokesperson for McDonalds, Heidi Barker Sa Shekhem, said in a statement:

    “McDonald’s and our independent franchisees are committed to undertaking a comprehensive investigation of the allegations and will take any necessary actions as they apply to our respective organizations.”

    Some of the lawsuits were leveled at area franchises, as opposed to the parent McDonald’s corporation, though 2 of the suits did name the headquarters company.

    The Tribune went on to report that one of the attorneys in the case, one Joe Sellers, had said in a statement:

    “In the past, McDonald’s has tried to shield itself from liability from these unlawful employment practices committed at its franchise restaurants. We believe it is time McDonald’s accepts responsibility for the pay practices at its franchise restaurants.”

    One of the workers, Jason Hughes, says that the wage theft consisted of his being asked by management to clock out during slow periods during the day, but to remain on the premises, ready to clock back in when things got busy.

    McDonald’s is no stranger to lawsuits. The infamous “hot coffee” suit polarized people for years, and provided fodder for late night comedians and politicians alike. But the Golden Arches have also seen suits over obesity and, in one strange case, damages for a man only being given a single napkin with his order.

  • Joakim Noah Leads Bulls In Overtime Win Over Heat

    Joakim Noah scored 20 points, 7 assists, and 5 blocks for the Chicago Bulls in Sunday’s game versus Miami Heat. Noah filled up his team’s stats and led them through an overtime victory with a final score of 95-88.

    The Miami Heat are the two-time defending champions and have eliminated the Bulls twice during the last three seasons, making Sunday’s game a special treat for the center. Noah is on his seventh year in the league and has just made the All-Star team for the second consecutive year.

    Noah says his hate for the Heat isn’t personal, and stems more from wanting what the other team has: “I want a championship,” he says, and he knows that to get there, his team has to beat the Heat first. “I want everyone who wears a Bulls jersey to work. We’re going for one thing. That’s the championship,” he says with conviction.

    Noah took the reins with the absence of Derrick Rose, who is sitting out the season to recover from his knee surgery. Rose was the team’s dominant scorer, and without him, the Bulls have had to win games by playing good defense, something that Noah says they work on every day.

    “Defense is all about repetition, having trust in your teammates,” he says. He gives credit to the Bulls’ coach Tom Thibodeau for his drilling in the defensive aspect of the game.

    The Bulls have a lot of strong opponents to face in the coming weeks, including the Houston Rockets, San Antonio Spurs, Portland Trail Blazers, Indiana Pacers, and Oklahoma City Thunder. Noah keeps his eye on the prize—the championship. “One day, I want to party in Chicago and I want to see what that feels like.”

    Shooting guard Jimmy Butler, who scored 16 points during the game and guarded the Heat’s star player LeBron James, was all praises for his teammate, saying that Noah was a great leader who “puts the team on his back every night.”

    Miami Dolphins Defeat Bengals In Overtime

    In this week’s Thursday night game, the Miami Dolphins faced off against the Cincinnati Bengals, in a showdown that ended up going into overtime. The Dolphins were able to pull away with a victory in the end, scoring on a game-winning safety. The safety gave them the win with a final score of 22-20.

    The Miami Dolphins started the season off well, with a 3-0 start, only to drop their next 4 games. At 3-4, their season was already starting to look dreadful, but this game might have saved their season. The Bengals are at the top of their division, and were certainly the favorites to win the game last night, at 6-2 going into the game. While the Dolphins were on a 4 game losing streak, the Bengals had won their previous 4 games.

    The game concluded with a sack from defensive end Cameron Wake, who delivered the safety to Andy Dalton with 6:38 left in overtime. Dalton retreated to the goal line on 3rd-and-10, and was tackled by Wake for only the third safety in overtime in the history of the NFL.

    After his strong statement of a sack to end the game, Wake of the Miami Dolphins said “You just have to do whatever you can to get to the quarterback. It couldn’t have come at a better time. How much better could it have been than to have a d-lineman seal the deal?” Dalton is obviously embarrassed to end the game on that note, and mentioned that he did not see him coming, and also thought that he was out of the end-zone.

    The defense of the Dolphins really stepped up in this game, holding the Bengals to only 20 points, and getting multiple scores from the defense. Before the safety to end the game, the Dolphins also scored on an interception return for a TD in the third quarter. Their cornerback Brent Grimes caught a pass from quarterback Andy Dalton and was able to return the ball 94 yards, giving them a 17-3 lead.

    This score gave Grimes his first touchdown, and was also the fourth-longest interception return in the history of the Miami Dolphins franchise.

    At a record of 4-4, the Miami Dolphins will go into next week hoping to get another win, and be able to turn their season around. It should not be too hard to do so, since their next game is against the Tampa Bay Buccaneers, who have not won a game all season.
